Income and Affordability Requirements

The Act requires an affordability assessment before credit is granted: the provider must verify gross income, subtract statutory deductions such as PAYE and UIF, subtract the minimum living expenses prescribed in the affordability assessment regulations, and subtract existing monthly debt repayments. Lending without that assessment is reckless lending and is prohibited.
Short-term loans carry a high instalment relative to the amount advanced, so the assessment bites harder than it does on longer-term credit. Existing payroll deductions, garnishee orders and other debit orders reduce the net figure the assessment works from.
Where income varies, the assessment normally works from an average across the statements supplied, so a weak recent month lowers the amount available.
Credit and Financial Requirements
A credit bureau check is part of every application, and the result affects both the decision and the amount offered.
The agreement is regulated by the National Credit Act 34 of 2005 and the provider must be registered with the National Credit Regulator (NCR). Verify registration free of charge at ncr.org.za before you sign.
Repayment is collected by authenticated debit order under DebiCheck, which you approve through your own bank before the first collection. Without that approval the loan cannot be disbursed.
The Act caps what may be charged on short-term credit through prescribed maximum interest rates, initiation fees and monthly service fees. Ask for each to be itemised and for the total repayable amount before you sign — on short-term credit, the total is substantially more than the amount advanced.
