United States visas divide into two fundamentally different kinds. Non-immigrant visas are for a temporary purpose — visiting, studying, working for a period, exchange. Immigrant visas lead to permanent residence. The requirements, the process and the presumptions are different.

Choosing the right one is the first decision, and it is not always obvious. Someone who intends to settle should not apply as a visitor, and someone visiting should not be assessed as an intending immigrant. This page maps the categories.

Eligibility and Entry Requirements at a Glance

The main non-immigrant categories relevant to South Africans.

Passport and Travel Document Requirements

Most non-immigrant categories require something before you apply. F-1 requires an I-20 from an approved school. J-1 requires a DS-2019 from a designated sponsor. H and L categories require an employer petition approved by US Citizenship and Immigration Services. You cannot apply for these on your own initiative.

B-1/B-2 is the exception — you apply directly, with no petition or sponsor document. That is why it is the most common and also the most refused.

The immigrant categories are family-based, employment-based, and the diversity visa programme. Family-based petitions are filed by a qualifying US citizen or permanent resident relative. Employment-based petitions are generally filed by an employer, sometimes after a labour certification process.

The Diversity Visa lottery is a programme allocating a limited number of immigrant visas by random selection among entrants from eligible countries. Whether South Africa is eligible in a given year depends on immigration levels and changes. Entry is free through the official government site during the registration period — anyone charging you to enter is defrauding you, and this is one of the most common immigration scams targeting South Africans.

Dual intent matters. Most non-immigrant categories require you to demonstrate you will return home. Some — notably H-1B and L-1 — permit dual intent, meaning you may pursue permanent residence without prejudicing the visa. Knowing which category you are in changes what you may say and do.

Financial, Health and Entry Conditions

Confirm every figure and requirement before you apply. Visa fees, processing times, forms and document lists change frequently and differ between missions and application centres. Work only from the issuing authority’s own official website, and treat anything else — including this page — as orientation rather than as the requirement.

Answer every application truthfully. Misrepresentation to a consular officer can result in a permanent bar, which is far worse than any refusal. Previous refusals, overstays anywhere, and criminal matters must be disclosed where asked.

Immigrant visa applications require civil documents and a medical examination by a panel physician, plus police certificates from every country where you have lived for a prescribed period. South African unabridged certificates and police clearances take months — start them early.

Beware of immigration fraud targeting South Africans. The commonest forms are charging for Diversity Visa entry, which is free; selling job offers or petitions; and claiming to be able to expedite decisions. Only accredited representatives or licensed attorneys may give immigration advice for a fee in the United States.

The visa is not the entry. Admission is decided by a border officer, who sets the period of stay. A visa valid for years does not permit a stay of years.

Overstaying has severe and long-lasting consequences, including bars on returning that can run for years. It is triggered by shorter overstays than people expect.

South African children travelling are subject to documentation requirements applied at departure, commonly including the unabridged birth certificate and, where a child travels without both parents, parental consent in the prescribed form. Confirm the current position with the Department of Home Affairs before travelling.

On agents and “guaranteed” visas. You do not need an agent, applications can be made directly, and official fees are published. Nobody can guarantee an outcome. Anyone offering to obtain a visa outside the normal process, or asking for payment to influence a decision, is not operating lawfully — and false documents result in refusal and, commonly, a multi-year ban.

How to Prepare or Apply

Identify the correct category first, on the official US Department of State site. If the category requires a petition or sponsor document, that comes first and is obtained by the school, sponsor or employer.

Then complete the application, pay the fee, book the interview as early as wait times allow, and prepare your answers as well as your documents.

Frequently Asked Questions

What is the difference between immigrant and non-immigrant visas?

Non-immigrant visas are for a temporary purpose and generally require you to show you will return home. Immigrant visas lead to permanent residence and follow a petition-based process.

Can I apply for a work visa myself?

Generally not. H and L categories require an employer petition approved in the United States. B-1/B-2 is the main category you apply for directly.

Is the Diversity Visa lottery free?

Yes, through the official government site during the registration period. Anyone charging you to enter is defrauding you — it is a common scam targeting South Africans.

What is dual intent?

Some categories, notably H-1B and L-1, permit you to pursue permanent residence without prejudicing the visa. Most others require you to demonstrate you will return home.

Visa categories, petition requirements, fees, lottery eligibility and interview availability are set by the US Department of State and US Citizenship and Immigration Services and are revised. Confirm current requirements on the official US government websites.
